In both these matters, the petitioners had already been provisionally allotted industrial plots and they had deposited earnest amounts in August and September 2016. Both, thereafter, could not pay the requisite amount within the period prescribed and subsequently their provisional allotments were cancelled.

The learned Advocate representing the Maharashtra Industrial Development Corporation (MIDC), submits on instructions, that the plots are not allotted on individual applications. The MIDC floats an advertisement and after such advertisement is published, interested parties are to apply on-line and after completing the formalities and in accordance with the Rules applicable, the allotments are made. In future, if the MIDC publishes such an advertisement, the petitioners are at liberty to apply on-line and their applications would be considered on their own merits.

In view of the above, these petitions are disposed off. Needless to state, whenever an advertisement is published by the MIDC and if the petitioners are interested, they are at liberty to move an on-line application.
