Mr.Katneshwarkar, learned counsel submits that the petitioners would satisfy even if direction is given to the respondents to decide their entitlement to receive the gratuity amount.

2] Mr.Shelke, learned counsel for respondent submits that in fact the respondent had sought guidance from the Divisional Commissioner who in turn has approached the Government and some queries have been raised.

3] In view of the fact that petitioners have given representation/applications for payment of gratuity, the respondent may take decision about the entitlement of the

{2} wp7837-14.odt petitioners to receive the gratuity amount within a period of three months and in case the respondent comes to the conclusion that the petitioners are entitled for any amount of gratuity, then the payment shall be made within a period of three months of the decision being taken. Writ Petition is accordingly disposed of. No costs.
