Atik Gulamhusen Qureshi v. The State Of Maharashtra And Others
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD CRIMINAL WRIT PETITION NO.1102 OF 2023 ATIK GULAMHUSEN QURESHI
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS Ms. Sunita G. Sonawane, Advocate for the petitioner Mrs. G. L. Deshpande, APP for the respondent/State CORAM : R. M. JOSHI, J.
DATE : 31st JULY, 2023 P.C. :- 1.
At the outset learned counsel for the petitioner states that due to short period granted by the concerned authority for undergoing the surgical procedure, the surgery could not be performed. It is her further contention that the period of five days granted by the concerned authority for this purpose is not sufficient. 2.
Learned APP submitted that since the order was granted on the basis the certificate provided earlier and in view of the fact that no surgery is performed till date, it is just and necessary for the petitioner to move fresh application before the concerned authority. 3.
Having regard to these facts, liberty is granted to the petitioner to move concerned authority for seeking permission of entry in 51.criwp1102.23.odt
the district Ahmednagar. It is also open for the petitioner to satisfy the concerned authority the maximum required time for medical/surgical procedure. In view of this, petition is disposed of. (R. M. JOSHI, J.) ssp 51.criwp1102.23.odt
