Learned Advocate for respondent No.2 places on record terms of compromise stating that respondent No.2 started cohabiting with applicant No.1 - husband, since 31st July 2025. 2.
It will not be out of place to mention here that by order dated 22nd August 2024, when disinclination was shown to grant any relief to applicant Nos.1 to 3, learned Advocate for the applicants, on instructions, sought withdrawal of the application as against them and therefore the Application stood disposed of as withdrawn as against applicant Nos. 1 to 3. Now, in view of the settlement and resumption of cohabitation by respondent No.2 with applicant No.1 and as the dispute was arising out of
the matrimonial dispute, we recall the order dated 22nd August 2024. Respondent No.2 has no objection for quashing the entire proceedings arising out of the First Information Report lodged by her. Hence, we pass following order:-
O R D E R
(I) The Application stands allowed.
(II) The proceedings in R.C.C. No. 233 of 2024 pending before the learned Judicial Magistrate First Class, Gangapur, Taluka-Gangapur, DistrictChhatrapati Sambhaji Nagar, arising out of the First Information Report vide Crime No.158 of 2024, registered with Gangapur Police Station, District-Chhatrapati Sambhaji Nagar, on 29th March, 2024, for the offence punishable under Sections 498-A, 323, 504, 506 read with Section 34 of the Indian Penal Code, stands quashed and set aside as against applicant Nos. 1 to 5 i.e. - 1) Laddu Ibrahim Pathan, 2) Madina Begum Ibrahim Khan Pathan,3) Sadek Ibrahim Pathan, 4) Noor Jahan Naser Pathan and 5) Parveen Bano Ismail Sayyed.
