None present for the petitioner. However, learned counsel for the respondents and learned A.G.P. are present. 2.

By way of this writ petition, the petitioner has challenged the order dated 11.12.2007 passed by the learned Civil Judge, Junior Division, Akole, District Ahmednagar below Exh.28 in Election Petition No. 1 of 2007. The said election petition came to be filed in respect of village Panchayat elections of Lahit Khurd, Tq. Akole, district Ahmednagar. After the election, the petitioner/respondent No.1 and her representative both had filed an application seeking recounting of votes after realizing of their defeat by small margin of mere two votes. However, even after recounting of votes, the Returning Officer has declared the result. However, thereafter the election petition came to be filed. In the pending election petition, the application Exh.28 came to be filed. However, the said application

wp269.08 -2came to be rejected and therefore, this writ petition has been preferred.

It appears that due to efflux of time, the writ petition has become infructuous. The said election was for the period of 2006 to 2011. In view of the same, the writ petition is hereby dismissed as infructuous. Rule discharged. Writ petition is accordingly disposed of.
