20 CONT. PETITION NO. 545 OF 2015 IN WP/8901/2014 DAULAT SHEKU GADEKAR AND OTHERS

VERSUS

DINESHKUMAR JAIN AND OTHERS ...

Advocate for Petitioners : Mr. S.P. Nagapurkar AGP for Respondents: Mr. P.S. Patil Advocate for Respondent No.4 : Mr. D.B. Pawar ...

CORAM : R. M. BORDE & K.L. WADANE, JJ.

Date: June 13, 2016 ...

PER COURT :- Affidavit in reply has been presented on behalf of the respondents, wherein, it has been recorded that the amount payable to the petitioners under the Act of 2013 is redetermined and on such determination, the amount has been actually paid. The petitioner contends that, actual land acquired belonging to the petitioner No.3 is to the extent of 17 R, whereas the amount of compensation paid is for 10 R land.

It does appear from perusal of the record that the declarations issued under sections 4 and 6 of the Land Acquisition Act concerning petitioner No.3 are in respect of 10 R land. If at all the petitioner disputes the area under acquisition, he can avail remedy provided under the Act.

Since the direction issued by this Court has been complied with, nothing survives for consideration in the Contempt petition. The contempt petition stands disposed.
