Applicant apprehends arrest in connection with Crime No. 0117/2023 registered with Shahada Police Station, Tq. Shahada, Dist. Nandurbar for offences punishable under Sections 363, 427, 452, 504 read with Section 34 of Indian Penal Code. 2.

According to the frst informant, on 13th March, 2013, at around 3.45 pm, applicant and his brother came to the house and kidnapped minor girl who is the niece of the present applicant from the custody of informant.

Learned counsel for applicant relied upon the order dated 3rd August, 2023 passed in Criminal Writ Petition No. 995/2023 recording that the sister-in-law who is the ex-wife of brother of applicant has agreed to give no objection for grant of bail to the father in connection with the very same crime. It is further observed that the father and brother may also rely upon this order in anticipatory bail application fled, if any.

It seem that compromise is arrived at between the wife and husband and therefore she has recorded 'no objection' for grant of anticipatory bail to the husband. This Court fnds no reason for denying him the same relief. Hence, application is allowed in terms of the interim order.
