1] Accused no.1 is in jail from the date of his arrest, while other two accused/applicants were on bail.

2] Heard learned counsel for the rival parties.

3] Perused the notes of evidence and in particular the evidence of PW 4 Ashok, the father of the deceased. 4] Looking to the nature of the incident, which occurred due to the quarrel amongst the members of the family i.e. applicants and the deceased over the property and looking to the fact that this court is not in a position to take up appeals finally early and further the applicants do not have any criminal background, we think, the following order would sub-serve the purpose.

O R D E R

(i) Criminal Application No. 4391 of 2015 is allowed.

crap4391.15 (ii) Applicant No.1-Arvind Sudhakar Patil, No.2Sudhakar Shripat Patil, and No.3-Latabai Sudhakar Patil, shall be released on bail upon they each furnishing P.R. bond in the sum of Rs.20,000/- with two solvent sureties in the like amount by each of them.

(iii) Applicant Nos.1 to 3 shall attend police station Taluka Dhule on last Sunday of each month between 11.00 a.m. and 4.00 p.m.
