The learned counsel submits that the petitioner had participated in tender process flouted by respondent no.2 for the Solid Waste Management and Clean Nagar Scheme under which 10 'VIKRAM' 3 wheelers were required to be purchased. The petitioner paid earnest amount of Rs.30,600/- and Rs.85,000/- towards the security deposit. The service was provided by the petitioner in which bills of Rs.25,415/- were also generated. The petitioner consistently approached respondent no.2 by filing various representation for refund of deposit and payment of bills. However, no cognizance is taken.

The learned A.G.P. accepts notice for respondent no.1.

It appears that, there were business transaction between the petitioner and respondent no.2. The petitioner was a successful bider. Further contract was executed between the parties and some services were provided by the petitioner. The petitioner is approaching this Court after long slumber of 20 years. It would not be possible in writ jurisdiction to consider the claim of the petitioner after long slumber of 20 years considering the business transactions.

In light of that, writ petition is disposed of. No costs.
