This application is for withdrawal of the amount deposited by the appellant in appeal in the office of this Court alongwith interest. The learned S.L.A.O. has awarded compensation at the rate of Rs. 8800/- R. The learned Reference Court has enhanced the amount of compensation and granted at the rate of Rs. 20,000/- per R. The enhancement is within four times. Therefore, this Court is inclined to pass following order :

ORDER

(I) The applicant is permitted to withdraw 50% of the deposited amount alongwith accrued interest on executing usual undertaking. Further 25% of the amount is allowed to be withdrawn on furnishing solvent surety/security to the satisfaction of the learned Registrar (Judicial) of this Court. Remaining amount be kept in a fixed deposit till disposal of the appeal. (II) With this, the civil application stands disposed of. ( KISHORE C. SANT, J. ) P.S.B.
