Order :-

An application is tendered in the form of appeal with the State Government claiming refund of the amount by petitioner on account of his inability to excavate the sand under the terms of agreement. Although the petitioner has alternatively prayed for extension of period to lift 8571 brass sand, under the policy prescribed by the State Government, such request is not entertainable. A request made by the petitioner for refund of the amount shall be considered in consonance with the policy of State Government as well as facts of the case. Appropriate order shall be passed by respondents No. 1 and 2 to that effect, as expeditiously as possible, preferably within a period of three months from the date of this order and it is accordingly directed. 2.
