Mr. Rakesh Rathod and Ms. Vijayalaxmi Khopade, Advocates for applicant Mr. A.B. Girase, PP for Respondents No. 1 and 2 .....

CORAM : K.K. SONAWANE, J.

DATED : 3rd AUGUST, 2017.

Order :- 1.

After pronouncement of the order in present criminal revision application, learned counsel for the applicant fervidly submits that the applicant-accused is intending to approach to the Appellate Forum to redress his grievance against the order passed by this Court. He further submits that the matter before the learned trial Court is listed tomorrow for further process. Therefore, he prayed to continue the interim relief granted under order dated 26th July, 2017 for further period of one week to facilitate the applicant-accused to approach to the Appellate Forum against the order passed by this Court. The learned counsel further undertakes that he would not seek further adjournment on this count before the learned trial Court. 2.

The learned Public Prosecutor Shri Girase raised objection and submits that applicant is not certain about the steps to be taken

2 Cri.revn166-17 against the order passed by this Court. Therefore, further time may not be granted. In case, further time is granted, it would cause hurdle in the progress of the matter before the learned trial Court. 3.

Considering the submissions on behalf of both sides, I find it justifiable to grant reasonable opportunity to the applicant-accused to approach to the Appellate Forum against order passed by this Court today. It would not cause any prejudice to the prosecution. Therefore, one week time is granted to facilitate the applicant to take requisite steps for rederessal of his grievance before the Appellate Forum. 4.

In the light of above, the learned trial Court shall not proceed further in proceedings pending before it till 11th August 2017 only. 5.

Registry to communicate this order to the trial Court. 6.
