Learned Advocate Mr. D.R. Jaybhar is present for the appellants/claimants. Learned Advocate Mr. R.H. Dahat is present for respondent No.2/Insurance Company. Insurance company - ICICI Lombard General Insurance Co. Ltd. has issued authority letter to Advocate Mr. Dahat. 02.

The learned Advocates for both the parties submit that they have amicably settled the lis and accordingly placed on record compromise terms. The compromise terms are marked as Article "X" for the purpose of identification.

The appeal is disposed off in the terms of compromise terms ("X").

Respondent No.2/Insurance Company shall deposit enhanced compensation of Rs.5,50,000/- (Rupees Five Lakhs Fifty Thousand) before MACT, Ahmednagar within a period of 45 days from the date of receipt of certified copy of the award.

The claimants are entitled to withdraw the amount of compensation in terms of Award passed by the Tribunal and learned Member, MACT, Ahmednagar shall pass necessary orders to that effect forthwith. 06.

The Chairman/Member, MACT, Ahmednagar shall adjust the statutory amount and amount if any, withdrawn earlier, in the amount of compensation and thereafter take necessary steps for making the payment. 07.

The Chairman/Member, Motor Accidents Claims Tribunal, Ahmednagar be informed accordingly.

08.

The Court fee refund certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959.

09.
