Learned counsel for the petitioner - original defendant submits that even though Exhibit-5 fled by the respondent - original plaintif came to be allowed by order dated 03.05.2014, on the same day, the trial Court has stayed the efect of the said order and even during the pendency of the Miscellaneous Civil Appeal bearing Appeal No.91 of 2014 preferred by the present petitioner - original defendant before the District Court, the District Court has also stayed the said order of temporary injunction and even after dismissal of the appeal for 15 days. Learned counsel submits that being aggrieved by the same, the petitioner - original defendant has approached this Court by fling the
908-WP-7858-2014 (2) present writ petition and by order dated 10.09.2014, this Court continued the order passed by the District Court upon an application Exhibit-16 in Miscellaneous Civil Appeal No. 91 of 2014.

In view of the above, by consent, the parties are directed to maintain status quo as on today in respect of the civil suit property till disposal of the Suit. The trial Court shall dispose of the Suit as expeditiously as possible, preferably within a period of nine months from the date of this order. 3.
The writ petition is accordingly disposed of. 4.
The Record and Proceedings shall be sent back forthwith to the trial Court.
