By way of present petition, the petitioner challenges the orders dated 09.06.2023 and 23.06.2023 passed below Exhibit 55 and 56 by the learned Civil Judge Senior Division, Newasa in R.C.S. No.470 of 2016.

Learned counsel for the petitioner submits that earlier cross-examination was conducted and subsequently, the application was filed by the plaintiff to permit him to lead the evidence through GPA. Therefore, the application was filed for discarding the crossexamination which was recorded earlier. 4.

Considering the above, as the evidence was already recorded, therefore, it is for the Trial Court to consider the same at the time of final hearing.
