1] Vide impugned order dated 28.02.2011 the Maharashtra Administrative Tribunal, Bench at Aurangabad, denied relief to the petitioner on account of he having less than five years of residual service left and thus was not considered for promotion. Petition succeeded to the limited extent of promotion of Respondent No. 6 being quashed.

WP 7471/11 - 2 - 2] Respondent No. 6 filed Writ Petition No. 3312/2011 which was allowed vide order dated 04.10.2011. Thus, as regards Respondent No. 6, the issue stands closed but as regards the petitioner he superannuated and as of today and the question of issuing any direction to consider him for promotion does not arise.

3] The petition is dismissed as infructuous.
