VERSUS

THE STATE OF MAHARASHTRA ANOTHER ...

Advocate for Petitioner : Mr. Hon Ashwin V.

AGP for Respondent State: Mr.U.S.Mote Mr.Deshmukh Mahesh S., Adv., for R/3.

...

CORAM : R. M. BORDE & P.R. BORA, JJ.

Dated: October 07, 2015 ...

PER COURT :- 1.

The petitioner is claiming interest at the rate of 12 per cent on account of delayed sanction of the pensionary benefits accruable to him. 2.

The petitioner approached this Court on earlier occasion by way of presentation of Writ Petition No.615/2014, which came to be decided on 5th May, 2014. The educational institution had pointed out during the hearing of the aforesaid petition that since the petitioner did not hand over original record, which was in his custody, to the Headmaster, who was holding the charge, the institution did not transmit the proposal of the petitioner. There is no lapse attributable to either the educational institution, or the officers of the Education Department, or the State Government in delaying the disbursement of the pensionary benefits to the petitioner. Since the respondents are not responsible for causing delay in disbursement of the amount of pension, and the petitioner himself is required to be blamed for the delay, the request made by the petitioner in the instant petition does not deserve consideration. The writ petition is devoid of substance and hence stands rejected. ( P.R. BORA, J. ) ( R. M. BORDE, J. ) ...
