The tribe claim of the petitioner is pending verification with the Scrutiny Committee. The petitioner is placed on supernumerary post.

The learned Assistant Government Pleader accepts notice for all respondents.

It is not disputed that, the tribe claim of the petitioner is pending verification with the Scrutiny Committee. The vigilance is also not yet conducted.

In the light of that, we pass the following order. 5.

The petitioner shall appear before the Committee on 21st

2 wp 10558.21 October, 2021. The Committee shall thereafter endeavour to decide the validation proceeding expeditiously and preferably within a period of six (06) months from the date of appearance of the petitioner. The petitioner shall co-operate in expeditious disposal of the proceeding. If the petitioner does not co-operate in expeditious disposal of the proceeding, the Committee may proceed ahead. The impugned order placing the petitioner on supernumerary post is quashed and set aside. Of course, the employer may take further course of action depending upon the judgment that may be delivered by the committee in the validation proceeding.

In the light of the above, the impugned order is quashed and set aside.
