The petitioners seek payment of rental compensation on the ground that the possession has been taken by respondents prior to the issuance of notification U/Sec. 4 of the Land Acquisition Act and by private negotiations. The learned counsel submits that on 27.08.2009 application is given to the authorities for payment of rental compensation, however, the same is not paid.

We have heard the learned Assistant Government Pleader and the learned counsel for the acquiring body.

In case the representation/application (Exhibit - C) is pending with the authorities for payment of rental compensation, the authorities shall decide the same expeditiously and preferably within a period of nine (9) months from today in accordance with law and on its own merits. The writ petition is disposed of. No costs.
