The learned Advocate for the Applicant/ Petitioner submits that the legal heirs of the deceased Respondent No.2 (Ratilal Lahoti) were actually brought on record before the Trial Court in Special Civil Suit No.10/1997 by the order below Exhibit 116 dated 13.10.2005. Inadvertently, the legal heirs of the deceased Respondent No.2 were not mentioned in the cause title of the petition. The learned Advocate for the contesting Respondent No.1 does not object.

For the above reasons, this Civil Application is allowed. The Petitioner shall add the legal heirs of the deceased Respondent No.2 (Ratilal) on record on or before 12.10.2018.
