Heard the learned Advocate appearing for the applicant and the learned APP appearing for the respondentState. 2.

The learned Advocate appearing for the applicant submits that this is first Bail Application of the applicant before this Court.

The learned APP informs that the trial before the Sessions Court has been substantially progressed. More than 10 witnesses have been already examined. The list of about 20 witnesses is given by the prosecution and trial is likely to be concluded soon.

The learned Advocate appearing for the applicant do not dispute that the trial is in progress. However, according to her, looking to the nature of the offence alleged and voluminous

(2) 927-ba-1303-2023 evidence to be tendered, it may take its own time. Therefore, seeks consideration of application on merits. However, in alternate, she submits that in case this Court permits applicant to move fresh application in case prolonged trial, she would withdraw this application with liberty to file fresh application. 5.

Considering the submissions advanced, the applicant is permitted to withdraw this application with liberty to file fresh application for grant of bail after four months, in case trial is not concluded within that time.

Bail Application is disposed of as withdrawn with aforesaid liberty.

It is clarified that this Court has not expressed anything on merits.
