Mr. Yeramwar, learned counsel submits that the caste claim of the petitioner has been invalidated without conducting vigilance. He referred to the endorsement in the roznama dated 17.07.2019 to suggest that vigilance has not been conducted. The petitioner had earlier filed writ petition bearing no.7730/2019 before the Principal Seat and in that provisional admission was protected up to 18.07.2019 and committee was directed to proceed further with the matter.

Mr. Yeramwar, learned counsel submits that the said writ petition was subsequently disposed of without any further orders.

The learned A.G.P. on going through the record accedes to the fact that vigilance has not been conducted.

In light of the above, we quash and set aside the impugned order and relegate the parties before the Committee. The petitioner shall appear before the Committee on 05.10.2019. The Committee shall direct vigilance to be conducted and shall thereafter decide the validation proceeding within three months from the date of appearance of the petitioner.

Writ Petition is disposed of. No costs.
