In view of our order dated 10.01.2025, an affidavit has been filed by Mr. Rakesh Narendra Ola, the then Superintendent of Police, Ahmednagar, wherein it was stated that although there was an order under Section 156(3) of the Cr.P.C. directing registration of an offence and investigation, the offence was not registered, but now offence has been registered vide C.R. No. 18 of 2025 at Kopargaon (Rural) Police Station on 22.01.2025, for offences punishable under Sections 417, 420, 465, 471 and Section 34 of IPC. It is further stated that the costs amount has been paid by him personally, from his own pocket. 2.

It would not be out of place to mention here that the petitioner had filed R.T.C. No. 120 of 2012, i.e. a private complaint before the

39-CRIWP-1541-24.odt {2} learned J.F.C.M., Kopargaon. By order dated 16.04.2012, the learned Magistrate directed investigation under Section 156(3) of the Cr.P.C. It further appears that on 02.08.2016, the same Magistrate disposed of the said case in view of the earlier order, whereby registration of FIR and investigation under Section 156(3) of the Cr.P.C. had already been directed. However, it appears that the said order dated 16.04.2012 was not implemented by the concerned Police Officer/Police Station, and therefore, this Court passed a detailed order on 10.01.2025. 3.
