With consent, the order dated 27th July, 2016, passed by Judicial Magistrate First Class, Newasa, below Exh.50, in S.T.C. No.366 of 2014, is set aside. Costs of Rs.2,000/- deposited in this Court is permitted to be withdrawn by the respondent herein.

The above referred order is subject to an undertaking given by the learned Counsel, that the applicant shall proceed ahead with crossexamination on the next date of hearing i.e. 5th November, 2016 and shall not seek unnecessary adjournments.
