The petitioner has been constrained to rush to this Court in the light of certain actions undertaken by the respondent - Municipal Corporation in the road widening drive undertaken recently. The petitioner apprehends that structure belonging to him, may be adversely affected and, therefore, the prayers in the writ petition pertain to a direction to restrain the respondent - Municipal Corporation from proceeding further in the matter.

Considering the urgency in the matter, we directed that the petition may be taken up on production board, with a further direction to serve copies on the learned counsel appearing for the respondent - Municipal Corporation.

When the petition is taken up for consideration, the learned counsel appearing for the Municipal Corporation, on instructions, makes a categorical statement that in the event the property / structure belonging to the petitioner is required for executing the project of road widening, the respondent - Municipal Corporation shall proceed further strictly in accordance with law and that the position of law clarified by this Court and the Supreme Court in various judgments, shall be followed in letter and spirit. According to us, the above statement, sufficiently addresses the apprehension of the petitioner and hence, no further orders are necessary in the matter.

With the aforesaid observastions, the writ petition is disposed of.
