The learned counsel for the petitioner submits that the petitioner has filed application under Section 28-A of the Land Acquisition Act (Exhibit C) and the same is pending. No decision has been taken upon it as yet.

The learned AGP appears for respondent nos. 1 and 2 and submits that in case such application filed by the petitioner is pending with the authority, the

wp9460.18 authority would decide it in accordance with law. 3.

In case, application (Exhibit C) under Section 28-A of the Land Acquisition Act is pending with respondent No. 2, the respondent No. 2 shall decide the same, on its own merits, in accordance with law, after hearing the parties concerned, expeditiously, preferably within eight months. 4.

Writ petition is disposed of. No costs.
