2.
Appellant is the original plaintiff who had filed Regular Civil Suit No.36 of 2008 for maintenance under Section 18 of the Hindu Adoption and Maintenance Act which was decreed partly vide judgment dated 30.10.2010 awarding maintenance of Rs.3,000/- per month. Being aggrieved, Regular Civil Appeal No.158 of 2010 was preferred by respondent/husband. It was allowed partly vide judgment dated 18.12.2012 reducing the maintenance to the extent of 2700/- per month. Being aggrieved, present second appeal is filed.
57-SA.100-14.odt 3.
I have gone through the judgments passed by Courts below. The Lower Appellate Court has recorded the findings of facts appreciating the material on record. No perversity or patent illegality is pointed out by the appellant. The reduction of maintenance is marginal. No substantial question of law can be made out from the appeal memo as well as the submissions of the learned counsel. I do not find that there is any merit in the second appeal.
4.
Second appeal is dismissed.
5.
In view of disposal of second appeal, pending civil application does not survive. Civil application as such is disposed of.
