Learned Judicial Magistrate, First Class, Rahta, by an order dated 20th March, 2012 convicted the applicant under Section 138 of the Negotiable Instruments Act and ordered to pay compensation of Rs.3,00,000/- in Summary Trial Case No. 330 of 2010, which was confirmed in Appeal No.7 of 2012 vide judgment and order dated 2nd August, 2016 passed by learned Additional Sessions Judge,

Learned Counsel for the applicant submits that the applicant has already deposited an amount of Rs.75,000/- during the pendency of appeal and he is ready and willing to deposit additional amount of Rs.75,000/- within a period of four weeks from today before this Court.

The applicant was on bail during the trial and in appeal. In view thereof, impugned sentence is suspended and he be released on bail, on the same terms, on which he was released on bail by the Court below.

Criminal Application stands allowed in above terms.
