IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 918 CIVIL APPLICATION NO.5702 OF 2021 IN FAST/22979/2020 SUBHASH BHAGUJI SUPARKAR

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Applicant : Ms. Akshara Sharad Madake h/f. Mr. Kale Abhijit B.

...

CORAM : SANDIPKUMAR C. MORE, J.

DATE : 15.11.2022 PER COURT :

Heard rival submissions. The applicant is seeking condonation of delay of 221 days which appears to be caused due to his financial crisis. The learned AGP strongly opposed the application on the ground that delay is not properly explained. The Acquiring Body though served remained absent. However, considering the statutory right of the applicant, the delay of 221 days stands condoned subject to condition that the applicant shall not claim any interest for the aforesaid delay period.

2.

The appeal be placed for admission after removal of office objections, if any.

3.

The application is disposed of accordingly.
