Heard learned counsel for applicant and learned counsel Mr. Harshawarshan Gawai, Advocate holding for Mr. A.P. Bhosle for respondent Nos. 1 and 2. Despite service of notice no one appears for respondent No.3 Insurance company.

Perused the application. The present application is filed for condonation of 34 days delay in filing first appeal against the impugned judgment and award of the Motor Accidents Claim Tribunal, Aurangabad in MACP No. 352 of 2013.

For the reasons mentioned in the application, there is no impediment to condone the delay of 34 days caused in filing the first appeal. Accordingly, the application stands allowed in terms of prayer clause (B). Delay caused for filing the first appeal is hereby condoned. Registry to take requisite steps for further process.

On registration of appeal, issue notice to respondents returnable on 17th July, 2018. Learned counsel Mr. Gavai, holding for Mr. A.K. Bhosale, waives service for respondent Nos.1 and
