ORDER :

Heard learned Advocate Mr. A. P. Bhandari appearing for respondents No.1 to 3. It is to be noted that the second appeal is pending for admission. Advocate Mr. M. D. Joshi was appearing for the appellants and in view of the death of learned Advocate Mr. M. D. Joshi, this Court prior to order dated 30-09-2019 had issued the notices to the appellants.

Thereafter, the notices were issued through Court and the appellants No.1 to 7 were served through Court notices, yet they did not remain present and, therefore, on 30-09-2019 one more opportunity was given to the appellants to cause their appearance on

SA 547-2011 04-11-2019, thereafter it appears that the matter was not listed. It is to be noted that there are concurrent findings against the present appellants. In spite of giving an opportunity to the appellants to point out the substantial questions of law, they are not coming forward.

Under such circumstances, the appeal stands dismissed. Consequently, the civil application also stands disposed of. (SMT. VIBHA KANKANWADI) JUDGE vjg/-
