IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

AURANGABAD BENCH, AURANGABAD CONTEMPT PETITION NO. 570 OF 2015 in CRIMINAL MISC. APPLICATION NO. 117 OF 2015 Sunil s/o Rajkumar Thakur

...Petitioner

VERSUS

The State of Maharashtra & ors.

...Respondents

.....

Shri R.D.Biradar, advocate for petitioner Shri B.L.Dhas, A.P.P. for respondent/State .....

CORAM : A.B.CHAUDHARI & INDIRA K.JAIN, JJ.

DATED : 6th OCTOBER, 2015 O R D E R :

1] Learned counsel for the petitioner submits that the parameters laid down by the Supreme Court in the case of Arnesh Kumar vs State of Bihar [(2014) 8 SCC 273] were not adhered to in the case of the petitioner who was arrested.

2] Admittedly, the petitioner did not have any order granting bail in his favour. The parameters themselves say that it is for the investigating officer to make arrest or not. We do not find any material to show that the parameters were not satisfied. There is no merit in the Contempt Petition.

3] Contempt Petition is dismissed.
