Even at the second call, none appears for the Applicant. Mr.Kasliwal, learned Advocate submits that the Applicant by this application seeks time to deposit the amount of Rs.15,000/- as was directed by this Court by order dated 25.09.2009 passed in Civil Application No.9583/2009 in Second Appeal No.650/2009. The Second Appeal has already been disposed of by the said order dated 25.09.2009. Mr.Kasliwal, therefore, submits that this application praying for extension of time for depositing Rs.15,000/- was filed on 30.08.2010

*2* 904.ca.12764.10 and as such, is rendered infructuous since the Applicant has made a statement in paragraph 3 on page 3 of the application that "but, now applicant is ready to deposit that amount as on today also,". He, therefore, submits that by recording his statement, this application be disposed of as being infructuous or may be dismissed in default. Recording the statement of Shri Kasliwal, this application is dismissed in default.
