The learned counsel for the applicants tenders copy of Death Certificate of Ramdas Bhimji Patil, who has died on 14.08.2006. The present applicants are his legal representatives and seeking withdrawal of amount deposited by respondent -MSRTC in the First Appeal Stamp.No. 6728/2007 which is already dismissed for want of steps in respect of bringing legal representatives of deceased Ramdas, on record.

The learned counsel for respondent -M.S.R.T.C. submits that there is no application for restoration of appeal is preferred by M.S.R.T.C. In view of the same, following order is passed :

ORDER

(i) The application is partly allowed.

(ii) The applicants are permitted to withdraw the amount of compensation as deposited in the M.S.R.T.C. in appeal along with the interest accrued thereon till date.

(iii) Office is directed to pay the amount only to applicant No.1 - Anita Ramdas Patil, who is widow of the original claimant. (iv) Application is disposed of accordingly.
