The learned Counsel for the applicant submits that instead of filing Writ Petition as against the rejection of the parole, the applicant whose appeal is pending against the conviction before this Court, has inadvertently filed the application in the said appeal.

The learned Counsel thus, on instructions seeks leave to withdraw this application with liberty to the applicant to file the Writ Petition. 3.
