VERSUS
THE DIVISIONAL JOINT REGISTRAR, CO. OPERATIVE SOCIETIES, NASHIK AND OTHERS ...
Advocate for the Petitioner : Shri A. D. Shinde AGP for Respondent Nos. 1 and 3 : Shri S. P. Tiwari ...
CORAM : RAVINDRA V. GHUGE, J.
DATED : 31st JULY, 2019.
...
PER COURT :
1.
In both these petitions, the same petitioner is aggrieved by the orders dated 14/06/2019 in two proceedings, by which, status quo order has been granted by the Divisional Joint Registrar, Cooperative Societies, Nashik. The matters were listed on 29/07/2019 and now have been adjourned to 05/11/2019.
2.
The learned Advocate for the petitioner makes a grievance that he is actually a whistle blower and it is on account of his initiation that certain proceedings have been
initiated under the Cooperative Societies Act. He has not been arrayed as a respondent before the Divisional Joint Registrarrespondent No.1, though he was a party to the proceedings before the Assistant Registrar - respondent No.2. He is aggrieved by the exparte orders impugned in these petitions. 3.
The learned AGP on behalf of respondent Nos. 1 and 2 submits, on instructions from respondent No.1, that tomorrow the said respondent would issue notices to all the parties and post the matter on 08/08/2019 as being the preponed date. The learned Advocate for the petitioner submits that he would approach respondent No. 1 on 08/08/2019 and shall file an application for being added as a respondent in the proceedings. The learned AGP submits that respondent No. 1 would consider the matter on its merits and would also consider such an application if filed by the petitioner, on merits.
4.
In view of the above, both these petitions are disposed off. Respondent No.1 shall issue notices to all the parties on or before 01/08/2019 and the returnable date in the matter
would be 08/08/2019 keeping in view that the petitioner has already committed that he would be filing an application for addition of parties.
5.
Considering the cause raised in these petitions and the cause appearing from the proceedings before respondent No.1, he shall endeavor to decide the said proceedings on their merits on or before 15/10/2019.
