The appointment of the petitioner is approved on aided post. The impugned order is passed refusing to enter the name of the petitioner in Shalarth Pranali on the ground that the transferred post was not in tune with the circular dated 28.06.2016.

The petitioner was appointed on unaided post on 01.10.2014 and was transferred to aided post on 05th March, 2020. His transfer to the aided post is approved. 3.

The circular dated 28.06.2016 would not be an impediment for the approval of the petitioner on aided post as he has already worked for six years on unaided post.

In the light of the above, the impugned order to the extent of the petitioner is quashed and set aside. The Deputy Director of Education shall consider the transfer of the petitioner to aided post as approved and take decision expeditiously and preferably within a period of six (06) weeks from today of placing the petitioner on Shalarth Pranali.

In the light of the above, the writ petition is disposed of. No costs.
