Heard Mr. Swami, learned counsel for the petitioner.

The learned counsel submits that the petitioner has filed the civil suit. In the civil suit, application was also filed seeking injunction restraining the defendants to withdraw the amount. The Court passed an order of status quo on 29.11.2017 and 10.01.2018. The order of status quo was continued till the next date. The
2 wp 9729.19 impugned order is passed in June-2019. The operative part of the order reads as under - "

The petitioner had already resorted to the proceeding before the Civil Court and the suit filed by the petitioner for declaration of the sale deed and the decree passed is pending.

Considering the pendency of the civil suit, the competent authority has passed the afore referred conditional order. It appears that the petitioner has also filed application before the civil Court under Order XXXIX Rule 2A before the civil Court. The petitioner may prosecute the application on its own merits.

Considering the above, the impugned order needs no interference at the hands of this Court, as the dispute is already subjudice before the civil Court.

Writ Petition is disposed of. No costs.
