The petition is filed to challenge the judgment and order of Dispute No. 84 of 2014 (Old No. 9 of 2012) filed before the Co-operative Court, Latur.

It is the contention of the petitioner - original defendant that the society had filed proceeding under Section 138 of the Negotiable Instruments Act that complaint was dismissed. The learned Counsel submitted that no notice was served on present petitioner of the dispute filed before the Co-operative Court and so present proceeding is filed. 1 / 2

In co-operative societies, the decision given by the Cooperative Court is made appealable before the appellate tribunal. As there is such provision, petition is not tenable. Same is dismissed. Liberty to go before the appellate tribunal.
