PER COURT :- 1.

By consent, since respondents are now residing within the jurisdiction of Family Court, Aurangabad, as has been conceded by the learned counsel for respondents, the impugned order dated 21st July, 2022 is hereby set aside. The proceedings Petition No.D-4 of 2022 stood restored to the file of the Family Court, Aurangabad. 2.

Parties here agreed that they shall be appearing before the Judge, Family Court, Aurangabad on 4th May, 2023. Family Court Appeal stands disposed of.

Needless to state that the Family Court shall decide the rival claims of the parties based on the material before it and in view of the aforesaid observations shall not dispose off the proceedings for want of territorial jurisdiction.
