Mr. S. S. Rathi, learned Advocate for the Applicants submits that Respondent No. 5 has died and in connected Appeals, his legal heirs have been brought on record. He submits that, he may be permitted to delete the name of Respondent No. 5 from the array of respondents. 2.
In view of above, permission is granted to delete the name of Respondent No. 5 from the array of Respondents. Necessary amendment to be carried out forthwith.

This is the Application for condonation of 55 days delay caused in preferring the First Appeal challenging the Judgment and Award dated 18.02.2017 passed in Motor Accident Claim Petition No. 45/2010 by the learned Member of the Motor Accident Claims Tribunal at Jalna.

Learned advocate Mr. Mahesh R. Sonawane appears on behalf of Applicant Nos. 1 to 4 and 7. None appears for Respondent No.6.

For the reasons mentioned in the application, same is allowed in terms of prayer clause 'B'.
