Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant seeks bail in connection with FIR No.369/2024, dated 10/12/2024, registered with Mukhed Police Station, District Nanded, for the offences punishable under Sections 420, 406, 465, 466, 467, 468, 471, 473, 294, 507, and 120-B of the Indian Penal Code, 1860. 3.
Learned counsel for the applicant seeks bail on the ground of parity. It is submitted that by order dated 24/07/2025 in Bail Application No.685/2025, this Court granted bail to co-accused Javed Razaq Tamboli, whose role is stated to be identical to that of the present applicant. 4.
On perusal of the record, it is seen that the allegations against the applicant are that he received Rs.13,90,000/- from the informant and one other person, whereas co-accused Javed Tamboli received Rs.30,00,000/- from five different individuals. It is further alleged that other candidates were also cheated in a similar manner by the informant, but no grievance has been raised by them against the informant.

It is also noted that the informant himself collected money from other candidates in a similar fashion, yet no grievance has been raised in that regard. Some amounts were allegedly transferred to accused Nos.6 and 7. It is submitted that co-accused Javed Tamboli accepted the amount in the presence of the applicant and that the main accused, Pawankumar Dharma Chavan, had promised various persons jobs in return for money. 6.
The learned counsel submits that the investigation is complete, and there are no criminal antecedents against the applicant except for another FIR lodged by the same informant relating to the same transaction, but at a different police station.

Considering that the role attributed to the present applicant is identical to that of co-accused Javed Razaq Tamboli, who has already been granted bail, and that the investigation is complete, the applicant is entitled to be released on bail on the ground of parity. 8.
In view of the above, the application is allowed in following terms : -
ORDER
(a) The application is allowed.
(b) The applicant shall be released on bail in connection with FIR No.369/2024, dated 10/12/2024, registered with Mukhed Police 2 of
108 BA 1470-2025 Station, District Nanded, on his executing a PR bond of Rs.30000/- with one or two sureties in the like amount, to the satisfaction of the trial Court.
(c) Upon release on bail, the applicant shall not contact the informant in any manner during the pendency of the trial. (d) The applicant shall co-operate with the trial Court and attend each date of hearing, unless exempted by the trial Court. (e) The applicant shall not tamper with the prosecution evidence or influence the informant, witnesses, or any other persons concerned with the case.
(f) The applicant shall furnish to the trial Court his contact number and residential address and update the same in case of any change.

In the event of breach of any of the above conditions, the bail granted to the applicant shall be liable to be cancelled. 10.
It is clarified that the observations made herein are restricted to the disposal of this bail application. The trial Court shall proceed independently and uninfluenced by the observations hereinabove. 11.
