Mr. Deshmukh, the learned counsel for the petitioner states that the petitioner was appointed as Assistant Teacher on 29.07.2002 and on completion of two years service, acquired the status of permanency. As the students' strength was reduced, the petitioner was declared surplus. On 3rd June, 2014, an order was passed by the authority directing absorption of the petitioner in Shantai Education Society, Pimpalner. However, the said Institution did not allow the petitioner to join. Subsequently, on or about 25th October, 2016, the petitioner has been allowed to join in the school run by Shantai Education Society, Pimpalner. The said grievance now does not survive. However, the respondents have not paid salary to the petitioner since July, 2013.

It is not disputed by the learned counsel for the respective parties that the petitioner now has been allowed to join on 25.10.2016 in the school run by Shantai Education Society, Pimpalner i.e. Swa. Sai. Shivram Nathu Wani Primary and Secondary School. 3.
Under the order dated 20.10.2016, we had directed the Education Officer to consider the quantum of salary that the petitioner may be entitled. Said exercise shall be done within a period of three months from today.

Needless to state that in case the petitioner is not satisfied with his grievance with regard to the salary, liberty to the petitioner to agitate the same, if occasion arises.

Writ petition No.8885/2015 stands disposed of. No costs.
