PER COURT :- The learned Advocate for the applicants strenuously submits that he deserves to be allowed to intervene in all the pending Writ Petitions. He was the person who raised an objection before the Cantonment Board, Ahmednagar as the petitioners were indulging in encroachment. Based on his objections, the Cantonment Board initiated steps to remove the encroachment. The petitioner approached the learned District Judge, who dismissed the Regular Civil Appeals filed by these petitioners under Section 4(1) of the
Public Premises (Eviction of Unauthorized Occupants) Act, 1971. After the appeals were dismissed on 6.10.2016, these petitioners are enjoying the ex-parte ad-interim relief granted by this Court (Coram : Sunil P. Deshmukh, J.), dated 24.10.2016. Thereafter, the matters were converted into the Writ Petitions and the same are yet to be listed for the admission hearing.
Learned Advocate for the petitioners submit that this applicant had approached the District Court by filing intervention application and such applications were rejected by the District Court. He submits that his statement may be recorded.
Considering the above, as the respondent in all the petitions is the Cantonment Board, which is competent of assising this Court, a request is made that these petitions be listed in the Urgent Admissions Category.
In view of the above, these civil applications are disposed off. List the Writ Petitions in the Urgent Admissions Category on 20.9.2019. The ex-parte ad-interim relief granted earlier to continue only till the next date.
Parties may note that a request for adjournment will not be considered and the petitions will be considered finally at the admission stage.
