The writ petition is filed with the following prayer:- "(A) The writ petition may kindly be allowed the Respondent no.3 may kindly be directed to initiate enquire pertaining to the complaint filed by petitioner on dated 10/11/2020 which disclose cognizable offence." 3.

The learned APP today submitted the communication dated 22.11.2021 issued by the A.S.I. Bhusawal Bajarpeth Police Station, mentioning that the concerned Police Station conducted

(( 2 )) 947-Cri-WP-1584-2020+ the inquiry in respect of the application filed by the petitioner alleging his cheating as claimed in the petition. The said report is taken on record and marked "X" for identification.

On going through the said report, it is evident that the concerned Police Station has inquired into the application filed by the petitioner and has come to the conclusion that the petitioner is not the owner of the property, but he filed such frivolous application. No cheating of the petitioner was disclosed in the inquiry and even the petitioner was asked to file appropriate proceeding in Civil Court, if so aggrieved. The petitioner did not sign the said letter. The report further indicates that the petitioner had even lodged one suit in Civil Court bearing No. 44 of 2016 for the same caus, but it was dismissed for default.

Be that as it may, the prayer in the petition appears to be complied with as the inquiry in the application of petitioner is already conducted. In view of the same, nothing survives in the present Writ Petition and the same stands disposed of being complied with. Needless to say, the pending Criminal Application No.2701 of 2021 also stands disposed of.
