It is submitted that pursuant to the order dated 21.11.2016, the Commissioner has taken decision for declaring the petitioner as surplus and absorbed respondent No.7 in place of the petitioner. It is submitted that the Commissioner decided the same on 05.12.2016 in favour of the petitioner.

Naturally, the Education Officer will have to act in accordance with the order passed by the superior authority dated 05.12.2016. The Education Officer shall consider the order dated 05.12.2016 passed by the Commissioner and comply the same within a period of two months.
