We have heard the learned Advocate for the petitioner and the learned APP on behalf of respondent Nos. 1 to 4. However, the matter had to be kept back since respondent No.4 Dr.B.B.Chavan, Education Officer, Secondary, though a resident of Aurangabad, did not reach the Court at 10.30 a.m. He tenders an apology.

The learned Prosecutor submits on instructions from respondent No.4 that considering the documents dated 08/02/2019 at page No.34 and 15/06/2019 at page Nos. 35 and 36 of the petition paper book, respondent No.4 would be registering a complaint with the appropriate Police Station against the then Head Master Mr. Baban Eknath Chavan and the representatives of the Management against whom the Auditor (Education) khs/Apr.2021/1586-d

- 2 - Aurangabad, has submitted a report. The learned Prosecutor further submits on behalf of respondent Nos. 2 and 3 that if such a complaint is filed, respondent No3. would conduct an investigation into the complaint and do the needful, as is prescribed under the Cr.P.C. 3.

The learned Advocate for the petitioner submits on instructions that the petitioner is satisfied with the statement and this petition is worked out.

In view of the above, this petition is disposed off. 5.

The learned Advocate for the petitioner, when called upon, submits on instructions that as the petitioner is a pensioner and Rs.50,000/- were deposited in this Court to show his bonafides, this Court may donate some portion of the amount for the treatment of Covid-19 patients. As such, the Registry of this Court shall transmit an amount of Rs.10,000/- to the District Collector, Aurangabad for a social cause (Covid-19 treatment) and the petitioner would be at liberty to withdraw Rs.40,000/- from this Court.
