At the outset, learned AGP raised a preliminary objection and submitted that, against the impugned order dated 08.03.2021 passed by the Divisional Commissioner-1, Aurangabad, substantive Revision under Rule 15 of the Maharashtra Zilla Parishad District Services (Discipline and Appeal)Rules,1964 is maintainable and without availing the said remedy, petitioner has directly approached this Court by invoking its jurisdiction under Article 226 of the Constitution India.

2. Facing with the said difficulty, learned counsel for the petitioner, on instructions, seeks leave to withdraw present petition with liberty to adopt statutory remedy available at the disposal of the petitioner.

3. Leave and liberty granted.

Petition is disposed of as withdrawn.
