Parties were referred for Mediation. It is was and it is reported to this Court on 21.03.2024 by learned mediator Mr.Kundan Jadhav. Settlement terms are on record which are marked as Exhibit-X-1. 2.

In pursuance of terms of settlement, the applicants have mustered funds by selling house. Learned counsel for the applicants has shown me demand draft of Rs.22,50,000/- to be deposited in this Court. They are agreeable that the amount deposited shall be disbursed to the Respondent No.1.Respondent No.1 undertakes to withdraw the proceedings in pursuance of their settlement. 3.

With the assistance of learned counsel for both sides, I have ascertained the identification of the respondent/Smt.Vandana Mahendra Jawale and Applicant No.2/Ravindra Laxman Jawale. They reiterate to stand by the terms of settlement. Considering the

2 948.CR.APP-2748-2023.doc nature of the proceedings, I am of the view that present application can be allowed in view of terms of settlement and undertaking of the respondent.

Criminal application is allowed in view of terms of settlement and impugned proceedings of Criminal Miscellaneous Application No.372 of 2022 stands quashed. Parties are ready to abide by the terms of settlement. The amount of Rs.22,50,000/-(Rupees Twenty Two Lacs Fifty Thousand Only) deposited in this Court shall forthwith be disbursed to the Respondent/Smt.Vandana Mahendra Jawale.
