Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.577 of 2023 registered with Vazirabad Police Station, District Nanded for the offences punishable under Sections 7 and 22 of the Narcotic Drugs and Psychotropic Substances Act.

It is the contention of the learned counsel for the applicant that the applicant has been arraigned in the crime on the basis of the statement of the co-accused. He was arrested after six days of the incident. He has no concern with the alleged incident. Nothing is to be recovered from him.

Learned APP submits that the applicant was consistently in contact with the co-accused on phone. The applicant hails from
940-ba-1398-2024.odt (2) Rajasthan but residing in Nanded. The offence is serious. Hence, he may not be granted bail.

The main accused has been granted bail in this crime. Considering the material collected against him, nothing appears to be recovered from him. He has been arraigned in the crime only on the basis of CDR report. The trial may take its time. Therefore, his detention would serve no purpose. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant, Rameshwarlal Udaylalji Gayari, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant should not tamper with the prosecution witnesses.
(b) The applicant should attend the police station as and when called on written notice by the investigation officer till filing the charge sheet.
